Pajak jual beli tanah mencakup PPh Final sebesar 2,5% yang dibayar penjual dan BPHTB sebesar 5% yang dibayar pembeli, yang wajib dilunasi sebelum proses balik nama sertifikat di Badan Pertanahan Nasional (BPN). Pemahaman pajak jual beli tanah dengan tarif yang jelas, dasar hukum seperti PP No. 34 Tahun 2016, serta pihak yang menanggung pajak menjadi kunci agar transaksi sah secara hukum dan tidak menimbulkan sengketa di kemudian hari.<\/p>\n<p><strong>Baca Juga: <a href=\"https:\/\/voffice.co.id\/blog\/subjek-pajak-adalah\/\">Subjek Pajak: Pengertian, Dasar Hukum dan Perbedaannya<\/a><\/strong><\/p>\n<h2><strong>Jenis Pajak dalam Transaksi Jual Beli Tanah<\/strong><\/h2>\n<h3><strong>PPh Final (Pajak Penghasilan Penjual)<\/strong><\/h3>\n<ul>\n<li><strong>Tarif<\/strong>: 2,5% dari nilai transaksi atau NJOP tertinggi.<\/li>\n<li><strong>Dibayar oleh<\/strong>: Penjual.<\/li>\n<li><strong>Dasar hukum<\/strong>: PP No. 34 Tahun 2016.<\/li>\n<li><strong>Contoh<\/strong>: Jika tanah dijual seharga Rp500 juta, maka PPh = 2,5% \u00d7 Rp500 juta = Rp12,5 juta.<\/li>\n<\/ul>\n<h3><strong>BPHTB (Bea Perolehan Hak atas Tanah dan Bangunan)<\/strong><\/h3>\n<ul>\n<li><strong>Tarif<\/strong>: 5% \u00d7 (Harga jual \u2013 NPOPTKP).<\/li>\n<li><strong>Dibayar oleh<\/strong>: Pembeli.<\/li>\n<li><strong>NPOPTKP<\/strong>: Nilai Tidak Kena Pajak, berbeda tiap daerah (misal Rp60 juta di Jakarta).<\/li>\n<li><strong>Contoh<\/strong>: Tanah dijual Rp500 juta. Maka BPHTB = 5% \u00d7 (Rp500 juta \u2013 Rp60 juta) = Rp22 juta.<\/li>\n<\/ul>\n<h3><strong>PPnBM (jika berlaku)<\/strong><\/h3>\n<ul>\n<li>Dikenakan jika objek jual beli tergolong barang mewah, biasanya tanah dan bangunan bernilai tinggi. Umumnya tidak dikenakan pada transaksi tanah biasa.<\/li>\n<\/ul>\n<h2><strong>Peran Notaris\/PPAT dalam Proses Pajak<\/strong><\/h2>\n<p>TPPAT bertanggung jawab memastikan bahwa seluruh kewajiban pajak telah dilunasi sebelum menandatangani Akta Jual Beli (AJB).
